Spotify and Major Labels Seek $322 Million Default Judgement in Anna’s Archive Case

This comes after Anna’s Archive has not responded to the lawsuit around its scraping of music files from Spotify

Spotify and the three major labels have made a motion to receive a $322 Million default judgment from Anna’s Archive, the shadow library website that scraped millions of songs from the streaming giant. As of this writing, Anna’s Archive has not responded to any motion related to the lawsuit.

The motion:

  • On top of the default judgment payout, the plaintiffs are asking for a permanent injunction on the website that would essentially ban the shadow library from existing on the internet.

  • The order would also require Anna’s Archive to destroy the files and not make them available to anyone else.

  • If the default judgment goes through, $300 million would go to Spotify, $7.5 million to Sony, $7.5 million to Universal Music Group (UMG), and $7.2 million to Warner.

Background:

  • The plaintiffs already acquired a similar injunction via court order, but that did little to prevent the website from finding new providers and remaining live.

  • The initial lawsuit against Anna’s Archive sought $13 trillion.

  • Anna’s Archive has removed Spotify torrent links from its search engine, but the music can still be shared through the peer-to-peer network.

  • Spotify and the record labels’ legal team: “Defendant’s blatant and willful disregard for Plaintiffs’ rights and the Court’s authority warrants imposition of statutory damages against Defendant for copyright infringement in the amount of $22,200,000, and for violation of the Digital Millennium Copyright Act (DMCA) in the amount of $300,000,000, as well as permanent injunctive relief."
